California Identity
Theft:
- A deception deliberately practiced in order to secure unfair or unlawful
gain.
- A piece of trickery; a trick.
- One that defrauds; a cheat.
- One who assumes a false pose; an impostor.
Penal Code Section
528 - 529 - Identity Theft
528. Every person who falsely personates another, and in such
assumed character marries or pretends to marry, or to sustain the
marriage relation towards another, with or without the connivance of
such other, is guilty of a felony.
529. Every person who falsely personates another in either his
private or official capacity, and in such assumed character either:
1. Becomes bail or surety for any party in any proceeding
whatever, before any court or officer authorized to take such bail or
surety;
2. Verifies, publishes, acknowledges, or proves, in the name of
another person, any written instrument, with intent that the same may
be recorded, delivered, or used as true; or,
3. Does any other act whereby, if done by the person falsely
personated, he might, in any event, become liable to any suit or
prosecution, or to pay any sum of money, or to incur any charge,
forfeiture, or penalty, or whereby any benefit might accrue to the
party personating, or to any other person;
Is punishable by a fine not exceeding ten thousand dollars
($10,000), or by imprisonment in the state prison, or in a county
jail not exceeding one year, or by both such fine and imprisonment.

Identity theft is one of the fastest growing
crimes in the nation, accounting for 43 percent of all complaints received by
the Federal Trade Commission in 2002. The FTC also reported that it received
161,800 complaints of identity theft–up 88 percent from 86,200 the year before.
Many believe that this is just a small fraction of the total number of victims.
In 2002, Star Systems conducted a telephone survey that they believe indicates
that as many as one in 20 adults, or 11.8 million Americans, have been victims
of identity theft.
According to a May 2000 survey by CalPIRG and the Privacy
Rights Clearinghouse, the average consumer victim spends 175 hours and $800
resolving identity theft problems, and it takes two to four years for victims to
clear up all the resulting problems. The sooner you take action to clear your
records, the better. That's why it's important to order your credit reports
regularly, at least once a year.
